Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the KickViewBot platform and services ("Service") provided by Octave Media Ltd ("we", "us", "our"), a private limited company registered in England and Wales (registered address: 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Service Description

KickViewBot is a software-as-a-service (SaaS) platform that provides streaming analytics, viewer metrics, and channel performance data for users of the Kick streaming platform. The Service is delivered entirely via web browser with no software installation required.

3. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding contract to use the Service. By agreeing to these Terms, you represent that you meet these requirements.

4. Subscriptions and Billing

The Service is offered on a monthly subscription basis. Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. All prices are displayed in GBP and are inclusive of applicable taxes where required.

Payments are processed by Stripe, Inc. By subscribing, you authorise Stripe to charge your payment method on a recurring basis. Octave Media Ltd does not store your card details.

5. Free Trial

New accounts may be eligible for a 7-day free trial. No charge is made during the trial period. If you do not cancel before the trial ends, your chosen plan will begin and your payment method will be charged.

6. Cancellation

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until then. Octave Media Ltd does not pro-rate refunds for unused portions of a billing period except where required by law.

7. Acceptable Use

You agree not to use the Service in any way that violates applicable laws or regulations, infringes the rights of any third party, or interferes with the operation of the Service. We reserve the right to suspend or terminate accounts that breach these Terms.

8. Intellectual Property

All content, software, and materials forming the Service are owned by or licensed to Octave Media Ltd. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for your personal or business purposes.

9. Disclaimer and Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Octave Media Ltd shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or via the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
